1. Scope and subject matter

These General Terms and Conditions of Sale (T&Cs) govern the contractual relationship between M.B.T.A (SAS, SIRET 513 947 325 00017), with registered office at 8 Square Alice, 93100 Montreuil, hereinafter referred to as "the Seller", and any professional or private buyer wishing to purchase a product or service offered on the website mbta.fr.

Any purchase implies unreserved acceptance of these T&Cs. The Seller reserves the right to amend them at any time; the applicable T&Cs are those in force at the date the order is placed.

2. Products and services

M.B.T.A offers two categories of products:

  • Standard stock products: ballast bags, rope protectors and rigging accessories available for immediate delivery.
  • Custom-made products: acrobatic harnesses, trapeze belts and all equipment designed and manufactured to the client's specifications (morphology, use, aesthetics). These products are hand-crafted in the MBTA workshop in Montreuil.
⚠️ Important — custom-made products: pursuant to Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Any validated custom order is firm and final.

Product photographs and descriptions are provided for information purposes only. Minor variations may exist, inherent in the handcrafted nature of the manufacturing.

3. Orders

Standard products: the order is confirmed upon basket validation, acceptance of the T&Cs and payment. A confirmation email is sent automatically.

Custom-made products: the order procedure is as follows:

  1. Initial contact via the quote form or by telephone.
  2. Submission of a specification sheet (morphology, intended use, technical constraints, desired aesthetics).
  3. Issue of a written quote by M.B.T.A, valid for 30 days.
  4. Signature of the accepted quote by the client and payment of a 50% deposit of the VAT-inclusive total.
  5. Commencement of manufacturing. The order becomes firm and irrevocable at this stage.
  6. Delivery and payment of the balance upon receipt.

M.B.T.A reserves the right to refuse any order incompatible with its technical capacity or contrary to its values.

4. Prices and payment

Prices displayed on the website are expressed in euros inclusive of VAT (VAT applicable in accordance with current regulations). Prices for custom-made products are established by quote and may vary according to materials, complexity and lead time.

Accepted payment methods: credit/debit card (Visa, Mastercard), bank transfer, cheque payable to M.B.T.A. Payment must be made in full prior to dispatch for standard products; by deposit then balance for custom-made products.

In the event of late payment, late payment penalties at the statutory rate plus 3 percentage points shall apply automatically, without prior notice (Article L441-10 of the French Commercial Code).

5. Manufacturing and delivery lead times

Standard products: dispatched within 3 to 5 working days. Delivery by carrier (Colissimo, Chronopost or dedicated carrier depending on weight).

Custom-made products: manufacturing lead time of 2 to 8 weeks depending on complexity, communicated at the time of the quote. This lead time runs from receipt of the deposit and final validation of the specification sheet.

M.B.T.A cannot be held responsible for delays due to force majeure, carriers, or incomplete information provided by the client.

Shipping costs are borne by the buyer, unless otherwise stated at the time of the order.

6. Right of withdrawal

⚠️ Custom-made products — NO right of withdrawal
Pursuant to Article L221-28 paragraph 3 of the French Consumer Code, the 14-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. This exception applies to all harnesses, belts and equipment manufactured to order by M.B.T.A.

Standard products: in accordance with Articles L221-18 et seq. of the French Consumer Code, any consumer buyer (non-professional) has 14 calendar days from receipt to exercise their right of withdrawal, without justification or penalty.

To exercise this right, the client must notify their decision by email to mbtafr@gmail.com or by post to: M.B.T.A — 14 rue des Pavillons, 93100 Montreuil. Return shipping costs are borne by the client. Reimbursement will be made within 14 days of receipt of the product returned in its original condition.

7. Warranties

All M.B.T.A products benefit from the statutory warranty of conformity (Articles L217-4 et seq. of the French Consumer Code) and the warranty against latent defects (Articles 1641 et seq. of the French Civil Code).

M.B.T.A commercial warranty: standard equipment is covered by a 12-month warranty against manufacturing defects. Custom-made products carry a 6-month warranty, subject to use in accordance with the intended purpose stated in the quote.

This warranty does not cover: normal wear and tear, damage resulting from misuse, inadequate maintenance, unauthorised modification, or accident.

⚠️ Safety and user responsibility: MBTA equipment (harnesses, acrobatic belts) consists of work and performance equipment intended for qualified professionals. Its use must comply with applicable safety standards. M.B.T.A accepts no liability for improper use or use without the requisite competencies.

8. Ownership of goods

M.B.T.A retains ownership of delivered products until full payment of the price by the buyer (retention of title clause). The transfer of risk takes place upon handover to the carrier or upon in-person delivery.

9. Liability

M.B.T.A's liability is limited to the amount of the relevant order. M.B.T.A cannot be held responsible for indirect damages, loss of business or consequential losses arising from the use or non-use of products.

It is the buyer's responsibility to ensure that the products ordered are suitable for the intended use and comply with the regulations applicable to their professional activity.

10. Personal data

Personal data collected during the order process is processed in accordance with the Privacy Policy of M.B.T.A, accessible on this website.

11. Mediation and disputes

In the event of a dispute, M.B.T.A undertakes to seek an amicable solution. Failing that, a consumer client may have free recourse to consumer mediation, in accordance with Articles L611-1 et seq. of the French Consumer Code.

Failing amicable resolution, any dispute between professionals shall be submitted to the Commercial Court of Bobigny (Tribunal de Commerce de Bobigny). For consumers, the competent court is the court of the consumer's place of residence.

These T&Cs are governed by French law.
